Tracking Abuse of Preemption Legislation in the States: April 26, 2022
During the 2022 state legislative session Local Solutions Support Center (LSSC) is publishing a weekly digest summarizing notable abusive preemption bills and their progress through session. This post will serve as an archive of all updates for the 2022 legislative session.

Updates and Trends in Our Top States
Trend 1: LGBTQ Rights
PA HB972: Would restrict trans students from playing scholastic and collegiate sports. Would create a private right of action for other parents or students against the school for not enforcing this requirement. The bill is in committee. See bill here.
Trend 2: Education
PA HB2521: Would prohibit public school instructors from engaging in certain instruction that the bill labels as “indoctrination”. “Indoctrination” relates to certain teachings on sex, gender, race, etc. Would also create a complaint mechanism for students and parents to protest “indoctrinating” instruction. This bill is in committee. See bill here.
AZ HB2161: Prevents certain rights of parents related to their child from so-called “interference” by a state, local government entity, or other governing body. Creates a complaint mechanism for parents to protest “interference.” This bill has been passed by both the state house and state senate and sent to the governor for signature. See bill here.
Trend 3: Workers’ Rights
AZ HCR2031: This constitutional amendment would make employee benefits, including wage and nonwage compensation, paid and unpaid leave, meal breaks, rest periods, and other absences a matter of statewide concern and not subject to local regulations. It would preempt all local regulation around these topics. This amendment has passed the state house and sent to the state senate. See bill here.
